Terms of Service

These Terms of Service ("Terms", "Agreement") govern your use of the web pages and services located at trovakap.com (collectively, the "Service"). This Agreement is between Trovakap ("Company," "We," "Our," "Us") and you ("You" or the "User").

By purchasing access to the Service, signing up for a consultation, or clicking a box indicating acceptance of these Terms, you agree to be bound by this Agreement, which includes our Privacy Policy.

If you do not agree with or cannot comply with this Agreement, you may not use the Service.

By engaging with our Service, you agree to subscribe to newsletters, marketing, or promotional materials we may send. You may opt out of receiving any of these communications from us by following the unsubscribe link in the emails or by emailing us at support@trovakap.com.

If you wish to purchase any service ("Purchase") made available through Trovakap, you will be asked to supply information relevant to your Purchase, including, without limitation, billing address and payment method details.

You represent and warrant that: (i) you have the legal right to use the provided payment method(s); and (ii) the information you supply is true, correct, and complete.

We use secure third-party services for payment processing. By submitting your information, you grant us the right to provide the necessary data to these third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to service unavailability, errors in pricing, or if fraud or an unauthorized transaction is suspected.

Some services are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring basis ("Billing Cycle"). Your Subscription will automatically renew under the exact same conditions unless you cancel it or Trovakap cancels it.

You may cancel your Subscription renewal either through your account management page (if available) or by contacting our customer support team.

Trovakap may modify Subscription fees at any time, in its sole discretion. We will provide you with reasonable prior notice of any change to give you an opportunity to terminate your Subscription before the change takes effect. Your continued use of the Service after the fee change constitutes your agreement to pay the modified fee.

Our Service may allow you to post, submit, or otherwise make available certain content ("Content"). You are responsible for any Content you provide, including its legality and appropriateness.

You retain all your rights to any Content you submit. By posting Content, you grant Trovakap a license to use such Content for the purposes of making the Service available to you (e.g., executing marketing campaigns).

Service and its original content, features, and functionality are and will remain the exclusive property of Trovakap and its licensors.

You may use the Service only for lawful purposes. You agree not to use the Service for:

• Illegal Activities: Engaging in any activity that violates any applicable local, state, national, or international law.
• Malicious Content: Introducing viruses, worms, Trojan horses, or any other material that is malicious or technologically harmful.
• Unauthorized Access: Attempting to gain unauthorized access to or disrupting any part of the Service, servers, or databases connected to the Service.
• Abuse: Using the Service to harass, abuse, spam, or harm others.

If you become aware of any violations, please report it to us immediately by contacting support@trovakap.com.

The Service is intended only for access and use by individuals at least eighteen (18) years old. By accessing or using the Service, you warrant and represent that you are at least eighteen years of age. If you are not at least eighteen (18) years old, you are prohibited from using the Service.

When you create an account, you guarantee that the information you provide is accurate and complete. You are responsible for maintaining the confidentiality of your account details and password.

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of these Terms.

If you wish to terminate your account, you may simply discontinue using the Service. All provisions that by their nature should survive termination (ownership, warranties, liability) will remain in effect.

By entering into an agreement for our services, the Customer hereby grants Trovakap the non-exclusive, royalty-free right to use the Customer's logo for promotional purposes. This includes using the logo on our website, in marketing materials, and case studies to reference the Customer as a client. This right remains in effect for the duration of the agreement and subsequent renewal periods, unless terminated by either party in writing.

THE SERVICE IS PROVIDED BY COMPANY ON AN "AS IS" AND "AS AVAILABLE" BASIS. COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICES, OR THE INFORMATION, CONTENT, OR MATERIALS INCLUDED THEREIN.

YOU EXPRESSLY AGREE THAT YOUR USE OF THESE SERVICES, THEIR CONTENT, AND ANY SERVICES OBTAINED FROM US IS AT YOUR SOLE RISK.

COMPANY HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

EXCEPT AS PROHIBITED BY LAW, YOU WILL HOLD US AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS HARMLESS FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGE, ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT.

IF LIABILITY IS FOUND ON THE PART OF TROVAKAP, IT WILL BE LIMITED TO THE AMOUNT PAID FOR THE PRODUCTS AND/OR SERVICES, AND UNDER NO CIRCUMSTANCES WILL THERE BE CONSEQUENTIAL OR PUNITIVE DAMAGES.

These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. These Terms constitute the entire agreement between us regarding our Service.

BY USING SERVICE OR OTHER SERVICES PROVIDED BY US, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM.
